Yes, in theory "XP mode" XP guests can be used under VirtualBox, provided it's on hosts which XP mode is licensed for. Otherwise the XP guest will fail its activation check.
I say "in theory" because AFAIK the feature is not well tested (rather, it was well tested when Win7 first came out, and barely mentioned since, except by people discovering that the differential image they stole from the office doesn't work at home). Generally it's easier IMHO to buy an XP license and not be bound by XP mode's restrictions.
