It seems something is messing up the contextual menu (it's missing items like Move to Trash). Do you see this same behaviour when you right click any file not in a search window?

I agree with rpmurray. Something is definitely wrong with the contextual menu. Either you have a third party extension that is causing problems or your OSX install is bad.

Thanks to everyone for your help, support & advice yet after trying all the above I still cannot get rid of these files.
To that end I will just reformat my SSD and put OSX on all fresh and never go within 1000 miles of the true trash which is virtualbox ever again!

No it only happens with those two vdi, contextual menu works fine with everything else!

It never ceases to amaze me that when end users, 99% of the time, manage to screw something up, want to blame either the hardware or software. I still think people should be required to obtain a Computer Operator's License before being allowed to purchase a computer.

so it's perfectly fine for you to call a piece of software that works perfectly fine for hundreds or thousands of users "trash" but you want to object to my post? got it.

A couple of suggestions to OP:
1) it could just be that these .vdi are in the trash. Mac OS X will not reclaim disk space until you empty the trash.
2) if your home directory is encrypted (vs. full disk encryption), you will also need to log out and log back in to recover disk space, after you empty the trash.
I cannot recommend only encrypting your home directory, as there are a number of other oddities with doing so besides the seriously annoying one above. If you need encryption, use the whole disk encryption available in Mountain Lion.
