AFAIK that is not true. The version knocking around is trialware/nagware, which you activate with a key once you are licensed. Definitely never free.

Not here you can't. Please note that "Abandonware" has no meaning in law. Copyright is the law, and that right persists for decades after the death of the author, certainly longer than the usefulness of this driver.
You might be willing to take the risk of the author climbing out the woodwork to sue you, but I suspect Oracle's lawyers will not be so relaxed about it.
