And if noone knows how I can fix this, how do I downgrade to 1.38 again?

Remove 1.4.0 and re-install 1.3.8
If is a virtual machine, is it still broken ?

But I can't seem to find 1.38 anywhere on the virtualbox site there are only 1.4.0 sources and synaptic also only give me the choice of installing 1.4.0

How did you install virtual box in the first place ? Did you not download (and save) the .deb ?

If not, same on you

I always keep a copy of .deb or source code I have installed in the system (outside of the official repositories) in the event you need to remove or modify it later.

And, FYI, the advice on upgrading has been to remove the old version and then install the new. I do not know if that may be a source of problems, but even if the package is in an innotek repository, check on proper proceedure for upgrading next time.

Saved states from 1.3.8 are not compatible with 1.4.0. Discard the saved state or go back to 1.3.8 and shut down the guest properly.
